Terms and Conditions for Elementally Yours LLC

By accessing this website or purchasing products from Elementally Yours LLC ("we," "us," or "our"), you agree to the following terms:

1. Product Disclaimer & Safety

• Candle Safety: Users must follow the safety instructions on the product label, including never leaving a burning candle unattended and keeping it away from flammable objects. By purchasing, you acknowledge that candles are a fire hazard and agree to use them at your own risk.
• Body Care Sensitivities: All products are for external use only. We recommend a patch test before full use.  Elementally Yours LLC is not responsible for individual adverse reactions to specific ingredients.
• Artisanal Variation: Due to the handcrafted nature of our products, minor variations in color, texture, or scent may occur. These are not considered defects but are hallmarks of the artisanal process.

2. Shipping & Handling

• Temperature Sensitivity: During summer months, body butters or soaps may soften or melt during transit. Elementally Yours is not responsible for products that change consistency due to heat during shipping.
• Damaged Goods: If items arrive broken, please provide a photo of the damaged product and packaging within 48 hours of delivery to info@elementallyyours.com to initiate a claim.

3. Returns & Refunds

• Hygiene Policy: For health and safety reasons, we cannot accept returns on used or opened soaps and body care products.
• Cancellation Window: Orders may be cancelled within 24 hours of placement if they have not yet entered the shipping process.

4. Regulatory Compliance (MoCRA 2026  & FDA) 

• Ingredient Transparency: A full list of ingredients is provided for every product. It is the customer's responsibility to review these for personal allergens.
• FDA Statements:  Our products are cosmetics, not drugs. They are not intended to diagnose, treat, cure, or prevent any disease. 

5. Limitation of Liability (The "Shield" Clause)
To the maximum extent permitted by law, Elementally Yours LLC shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products. Our total liability to you for any claim arising out of your purchase shall not exceed the purchase price of the product in question.

6. Governing Law & Venue
These terms are governed by the laws of the State of Nevada. Any legal action or dispute arising from these terms shall be settled exclusively in the courts located in Clark County, Nevada.
